this is to Andrew this scene was atually played out in the book only as Aragorn being Gandalf. Here is what Gandalf tells the king on Wormtounge, "With safety you cannot take it with you, nor can you leave it behind. To slay it would be just. But it was not always as it now is. Once it was a man, and did you service in its fasion. Give him a horse and let him go at once, wherever he chooses. By his choice you shall judge him." And just a few paragraphs earlier, Eomer made a move as though he were rdy to kill wormtounge but Gandalf stayed his hand. Hope that answers your question.
